Speeding no evidence

I was pulled over today by a plain car with uniformed officers in ... After refusing to give any ID ect for ages and they just kept going on and on I ended up giving it to them.... They have no video evidence , it is literally just their word against mine ... They said it might get thrown out, might be speed awareness course, or points which I doubt as its my first time... Is it worth contesting as there is no evidence or anything on their side... Or just go on the course if I get that.

Well if they offer a course just do it but you won't avoid points just because its your first time getting caught.

I'd say contest. They have no evidence to prove you was.
But was you speeding?

They must have evidence to put a speed on the ticket. They can't just pull a figure out of thin air. It could simply have been a measured time over a known distance. Doesn't need to be video evidence.

If you were speeding take the punishment. If you can't take the punishment don't do the crime:-) Depending upon the speed and the location, there is a good chance you'll get a speed awareness course in lieu of a fine and points for a first offence.

If you weren't then fight it.

They pulled me over for undertaking them, there's no evidence to say they wasn't doing 20mph in a 30mph as why I undertook them, I'm not fussed about taking the result of my action , the thing that is bugging me is that they have no evidence, it's the polices word against mine... I even said do you have any evidence they said no, I said how fast was I going , her exact words "I THINK YOU WAS GOING ABOUT 40MPH" ... I got arsey with them as soon as they followed me into my work to pull me, she also said "we was only going to give you a word of advice first" basically saying they gonna do me for speeding because I got arsey. Lol

You left out one key thing, was she fit?

I've been stopped and prosecuted for speeding more times than I care to remember but one thing I've learned that being "arsey" with them never gets you anywhere.

Ditto

With no video or radar evidence , then they would need to have a calibrated speedo in order to prove speed . I thought only traffic cars were routinely equipped with calibrated speedometers ? maybe not ? - either way if you decide to contest it , ask for the calibration certificate of whichever device they used to determine your speed.

Undertaking is considered to be 'driving without due care & attention' , undertaking at speed could feasibly fall within the realms of 'careless driving' . You better hope they dont report you for either of these offences , they are significantly more serious than exceeding a statutory speed limit and dont necessarily require any other evidence than a single officers word. With 2 of them to give the same evidence , you're goosed....

Not quite true.

Depends on the scenario.

If two officers both say that you were speeding they do not need an actual speed. So in theory, they can pull it out of thin air. It does not need to be between two fixed points either. You can be done for driving "in excess of" X mph.

Why did you (OP) not hand over your ID when requested? If you act like a tosser then they are more likely to bend you over.
And it sounds like you have acted like a bit of a tosser.
Even they said had you have just gone "ahh sorry maybe I was going a bit quick" they'd have just let you on your way!!?? Some people.

Depends about the "undertaking" - It is not actually illegal to pass a vehicle on the inside assuming both lanes are keeping up with traffic ahead of them. for example if the 2nd lane of a dual carriageway is going 30mph and the 1st lane is going 50 then you can legally "undertake". If you've gone past on the inside speeding then that can be classed as aggressive and therefore dangerous driving.

If they were going to prosecute you they would/should have provided you with an NIP at the roadside and the paperwork would come through the post later. If you have been issued an NIP then the 14 day rulebook goes out the window, but you would still be offered a Speed Awareness Course depending on the speed (In a 30 I think it's 34-42 for the course)

My old man once got done for undertaking. The pigs were sat in the outside lane late at night on the M1 at 60, waiting for someone to get fed up and pass on the inside. That someone was my old man. He contested it as entrapment and got let off.

I once got pulled over for 'driving dangerously and speeding in a village'. I wasn't. The car in front put his indicator on and pulled up against the kerb. I passed before he'd completely stopped but didn't exceed the speed limit. There was a policeman sat at the junction just down the road saw me do it and came after me. I contested that and got let off, although obviously I'd done nowt wrong anyway.

Another time I did get caught doing 70 in a 40. I was polite to them, gave over all my details without any fuss. They had a look round and a bit of a chat and let me go with a word of warning that they wouldn't be so lenient if they saw me speeding again.

They might be bellends at times, but it pays to be polite and keep a lid on your temper. They hold the cards, not you.

^^ Exactly what Lee said... I am surprised they didn't come right down on you when you were being arsey, maybe they only do that to certain people

As someone else as said, if there are two officers, it's not your word against their's, one officer can confirm the words of the other. Also, undertaking is serious and you could get points for that
